Grundsätzlich gilt in Österreich die Offene Kategorie A3 für den Modellflug, das bedeutet: 

• Registrierung als Betreiber gemäß europäischer Verordnung
• Kennzeichnung des Modells mit der Betreibernummer
• Als Mindestmaß der Kompetenz muss der Kompetenznachweis A1/A3 (Online Theorieprüfung It. UAS open 020 (4)(b)) vorgewiesen werden können
• Eine Modellflughaftpflichtversicherung mit mindestens 750.000 SZR muss auf Verlangen vorgewiesen werden können
• Alle Rahmenbedingungen gemäß UAS.OPEN.040 UAS-Betrieb in Unterkategorie A3 sind zu erfüllen, das sind:

• • 150m Abstand zu Wohn-, Industrie- und Erholungsflächen
  • Maximal 120m Flughöhe über Grund
  • Maximal 120m über Standort des Piloten mit maximal 10kg MTOM beim Hangflug gemäß UAS open 010 (4)
  • Maximal 25 kg Abfluggewicht
  • Keine Gefährdung unbeteiligter Personen
  • Mindestalter 16 Jahre

In Kontrollzonen ist, ausgenommen auf bewilligten Modellflugplätzen, die Genehmigung des Flugbetriebes mittels UTM erforderlich.

• Für Modellflugvereine gibt es die Möglichkeit, eine Artikel 16 Bewilligung zu erwirken, hier sind folgende Ausnahmen möglich:

• • Mindestalter auf 12 Jahre reduzierbar Abfluggewicht bis 150kg möglich
  • Flughöhe bis maximal 500m über Grund im Luftraum G möglich
  • In Kontrollzonen beträgt die einheitliche Flughöhe 150m AGL
  • Die mitigierenden Maßnahmen und Behördenauflagen sind den jeweiligen Bescheiden zu entnehmen:
  • Ab 120m Flughöhe ist ein Luftraumbeobachter, der selbst am Fluggeschehen nicht teilnehmen darf, Pflicht
  • Ab 300m Flughöhe ist Höhentelemetrie und eine Antikollisionsbeleuchtung verpflichtend (in Hangfluggebieten bereits ab 120m Flughöhe über Standort des Piloten)
  • Alle Bescheidinhalte, die ortsspezifische Modellflugplatzbetriebsordnung und weitere Modellflugrichtlinien sind von den Personen, die am Fluggeschehen teilnehmen, schriftlich zur Kenntnis zu nehmen
  • Es sind Betriebsaufzeichnungen zu führen, die Ort/Datum/Anzahl der Flüge/maximal geflogene Höhe/Einsatz eines Luftraumbeobachters enthalten müssen
  • Die Aufzeichnungen sind 5 Jahre aufzubewahren
  • Die Behörde auditiert die Bescheidinhaber

In Austria, the open category A3 applies to model flying, which means: 

• Registration as an operator in accordance with European regulations
• Marking of the model with the operator number
• As a minimum level of competence, proof of competence A1/A3 (online theory test It. UAS open 020 (4)(b)) must be presented
• Model aircraft liability insurance with a minimum coverage of 750,000 SDR must be presented upon request
• All general conditions in accordance with UAS.OPEN.040 UAS operation in subcategory A3 must be met, namely:

• • 150 m distance from residential, industrial and recreational areas
  • Maximum flight altitude of 120 m above ground level
  • Maximum 120 m above the pilot's location with a maximum MTOM of 10 kg for slope flying in accordance with UAS open 010 (4)
  • Maximum take-off weight of 25 kg
  • No danger to uninvolved persons
  • Minimum age of 16

In control zones, with the exception of approved model airfields, approval for flight operations via UTM is required. 

Model flying clubs have the option of obtaining an Article 16 permit, which allows for the following exceptions:

• • Minimum age can be reduced to 12 years
  • Take-off weight up to 150 kg possible
  • Flying altitude up to a maximum of 500 m above ground level in airspace G possible
  • In control zones, the standard flying altitude is 150 m AGL
  • The mitigating measures and official requirements can be found in the respective notices:
  • From a flight altitude of 120 m, an airspace observer who is not allowed to participate in the flight itself is mandatory.
  • From a flight altitude of 300 m, altitude telemetry and anti-collision lighting are mandatory (in slope flying areas, this applies from a flight altitude of 120 m above the pilot's location).
  • All contents of the notice, the location-specific model airfield operating regulations and other model flying guidelines must be acknowledged in writing by the persons participating in the flight.
  • Operating records must be kept, which must include the location/date/number of flights/maximum altitude flown/use of an airspace observer.
  • The records must be kept for 5 years.
  • The authority audits the decision holders.
